Firearm Purchase Delay Legislation Is Now in the Senate
CALL TO ACTION
House Bill 325 has passed the House, relying upon fraud and deception to win approval, and is now in the Senate awaiting action. This misguided legislation would go beyond federal law and extend the 3-day transfer period for NICS delays to 30 days — and more. Please contact your Senator and politely urge them to oppose House Bill 325 when it comes up for a vote.
But here’s the real story……. HB 325 creates a “black hole” that results in a never-ending cycle which deprives law-abiding citizens of their right to keep & bear arms… and the sponsors knew it when they chose the 30 day “delay”……..
- Fact #1: The overwhelming majority of gun buyers in Delaware who are “delayed” in NICS checks are law-abiding citizens who are eventually “cleared”.
- Fact #2: As many as 40% of all gun sales in Delaware are delayed during NICS checks.
- Fact #3: If you were in the military or other government service and held a security clearance, your chance of delay is very high – and the higher the clearance, the higher the probability of delay – and the higher the clearance, the longer the delay.
- Fact #4: Under the current law, an FFL may (but is not required) to complete the transaction if the FBI’s NICS Center does not call back within 3 business days – (It’s actually 5 days because neither the first or last day count).
- Fact #5. Over the last two (2) years, only 16 firearms were transferred in Delaware after the mandatory 3-day delay – and all of them were recovered by BATF with no crime being committed.
and what they didn’t tell the House!!!!
- Fact #6. A NICS Check is only good for 30 days – and the 30 days begins when the check is initiated (called in) – under HB 325 that creates a “black hole” – with a 30 day delay you could never get approval – the House Sponsors knew it and told no one.
- Fact #7. If HB 325 passes the Senate, then the FBI could simply delay all Delaware checks for 30 days and NO ONE could buy a gun in Delaware
